What is Tayko Members and who runs it?
These terms and conditions govern the Tayko Members scheme (hereinafter, the ‘Scheme’), owned by Tayko Hotels: Byou Hotels, S.A., with tax identification number (NIF) A95883344 and registered office at C/ Ribera 13, 48005 Bilbao (Bizkaia), registered in the Bizkaia Commercial Register in Volume 5688, Folio 18, Page 1/2017/6951.0, 1st Entry, and its group companies Tayko Bilbao, S.L., Tayko Sevilla, S.L. and Restaurante Ola Bilbao, S.L.
These terms explain how the Programme works for its members (hereinafter referred to as the ‘Member’ or ‘Members’). You can access the current version on this page at any time. By accepting these terms – either expressly or without the need for a signature – you confirm that you are aware of their content and agree to be bound by them for as long as you remain a member.
The benefits of the Programme apply only to the establishments, services and rates included in it at any given time. These terms and conditions supersede and render null and void any previous version, and are supplemented by the Legal Notice, the Privacy Policy and the Terms and Conditions spare.
Who can join and how to do so
Registration is free of charge. Natural persons aged 18 or over who have read and accepted these terms and conditions via the channels provided by Tayko Hotels may become Account Holders:
- On our website, by completing the registration form.
- At hotels participating in the Programme, by verbal confirmation or any other means made available to you by Tayko Hotels, through which you give your consent to join the Programme.
A unique and valid email address is essential. The same email address cannot be used for two or more members.
Legal entities (companies or other organisations) may not register or derive any benefits whatsoever: the benefits are personal and are enjoyed by the Account Holder themselves.
What are the benefits of membership?
To enjoy these benefits, you will need to log in as a member. As a cardholder, you can:
- Get a discount on the total net amount of your booking. Members enjoy a 10% discount on direct bookings.
- Access the exclusive benefits, perks and offers available under the Programme for your membership tier.
Categories
There is currently only one category, ‘Members’, which is assigned to all new Cardholders. Tayko Hotels may, at its discretion, assign special categories or benefits to certain groups of customers whom it deems appropriate, based on their field of work or influence, without them having to meet the conditions described here.
Where and how the discount applies
- The exclusive rates and benefits for Tayko Members apply only to bookings made on taykohotels.com or directly at the hotels in the Programme. They do not apply to bookings made through agencies or other platforms.
- These benefits cannot be combined with other discounts or promotions.
- Tayko Hotels determines the rates to which the member discount applies and the specific percentage for each. This allocation may be amended at any time, without prior notice, in accordance with its commercial policy, market conditions or other criteria it deems relevant.
Marketing communications and your data
By registering with Tayko Members, you voluntarily agree to join the Programme and give your express consent to receive marketing communications about Tayko Hotels’ services and promotions whilst you are a member. These may include, amongst other things, exclusive offers, news about events and special promotions.
You may withdraw this consent at any time. Withdrawal automatically results in your membership being cancelled and the loss of all associated benefits from that point onwards.
We process your data to manage your membership and send you our latest news. You will find all the information, and details on how to exercise your rights, on our Privacy Policy.
Your personal account
Once you have registered, and provided you log in correctly, you will have access to the Programme’s private pages. From there, you will be able, amongst other things, to view your bookings and nights booked, see your most recent stays, update your personal details, make bookings, view information about the Programme and carry out any other operations that Tayko Hotels makes available to you.
Tayko Hotels accepts no liability for unauthorised access by third parties to your private pages, nor for any fraudulent use that the Account Holder may make of the data or information.
How to unsubscribe
There is no expiry date for participation in the Programme. You can opt out at any time by emailing members@taykohotels.com, stating your full name and the email address linked to your account.
Voluntary cancellation results in the automatic loss of all privileges and benefits from the moment your account is deactivated.
When can Tayko Hotels cancel a membership?
Tayko Hotels may temporarily suspend or permanently terminate a Member’s membership in the following cases:
- If you have not used any Tayko Hotels products or services for 12 months.
- If you have misused or fraudulently used the Programme: breach of these terms and conditions, payment irregularities or inappropriate behaviour at the hotel, without prejudice to any claim for damages that Tayko Hotels may bring.
- Due to circumstances beyond our control or due to legal, governmental or other requirements that necessitate the cancellation of the Programme.
- Where required for business strategy reasons at Tayko Hotels.
- In the event of the Account Holder’s death or disappearance.
In all such cases, the Member automatically loses the benefits of the Programme. If the cancellation is due to Tayko Hotels’ business strategy, Members will have six months to enjoy the benefits they were entitled to during their future stays.
As this is a free programme, the Account Holder expressly waives the right to claim damages from Tayko Hotels in the event of the programme being cancelled in any of the circumstances set out above.
The sale or exchange of any Programme benefit is prohibited and will result in the immediate cancellation of membership.
Changes to the Programme and to these terms and conditions
Tayko Hotels reserves the right to amend these terms and conditions unilaterally at any time, as well as the list of establishments, services and rates included in the Programme. The new terms and conditions will be made available to you in the same way as these.
These terms and conditions are governed by Spanish law.
Liability
Tayko Hotels shall not be liable:
- The use or purpose for which the Account Holder utilises the Programme and its benefits.
- Any breach by the Data Subject of the obligations set out herein.
- Any shortcomings or errors in category management, data processing or other matters that are not directly attributable to Tayko Hotels or are beyond its reasonable control.
- Damages arising from the Licence Holder’s misuse of the Programme.
- It accepts no liability for the reliability, availability or continuity of its website or the services provided online, nor for any damage that may result from a failure in this regard, although it will endeavour to provide technical assistance to the affected person to the best of its ability.
- Damage caused by viruses or other elements that may affect users’ software or hardware. Tayko Hotels is under no obligation to check in advance that such elements are not present in the content of its web pages.
